1. Agreement to Terms

By accessing or using ChurchFinance ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service on behalf of an organization (such as a church, ministry, or nonprofit), you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

ChurchFinance provides cloud-based financial management software designed for churches and religious organizations. Our services include, but are not limited to:

  • Transaction and donation tracking
  • Budget management and reporting
  • Online giving and payment processing
  • Donor management and giving statements
  • Bank reconciliation tools
  • Financial reporting and board packet generation

3. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept responsibility for all activities under your account
  • Immediately notify us of any unauthorized use of your account

You must be at least 18 years old to create an account and use the Service.

4. Subscription and Payment

ChurchFinance offers various subscription plans. By selecting a paid subscription, you agree to pay the applicable fees. Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select.

Free Trial: We may offer a free trial period. At the end of the trial, your account will automatically convert to a paid subscription unless you cancel before the trial ends.

Refunds: Subscription fees are generally non-refundable except as required by law or as explicitly stated in our refund policy.

Price Changes:We reserve the right to modify our pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. User Content and Data

You retain ownership of all data and content you upload to the Service ("User Content"). By using the Service, you grant us a limited license to store, process, and display your User Content solely to provide the Service to you.

You are responsible for ensuring that your User Content does not violate any applicable laws or third-party rights. We reserve the right to remove any content that violates these Terms.

Data Export: You may export your data at any time using our data export features. Upon termination of your account, you will have a reasonable period to export your data before it is deleted.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit any malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Use the Service for any fraudulent or deceptive purposes
  • Collect or harvest information about other users without consent

7. Payment Processing

If you use our online giving features to accept donations, you acknowledge that payment processing is provided by third-party payment processors (such as Stripe). Your use of these services is subject to their terms and conditions.

We are not responsible for any issues arising from third-party payment processing, including but not limited to transaction failures, fraud, or chargebacks.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by ChurchFinance and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHURCHFINANCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or alteration of your data
  • Any third-party conduct on the Service
  • Any other matter relating to the Service

In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless ChurchFinance and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • You must cease all use of the Service
  • We may delete your account and data after a reasonable period

You may terminate your account at any time by contacting us or using the account settings.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
